The law is complex with many players including: carriers, employers and participants. Plus, the law governing
Cal-COBRA is in two different codes and two different agencies are charged with enforcing it.
Cal-COBRA applies to fully insured medical plans offered by:
- Employers subject to federal COBRA that have 20 or more employees (post COBRA)
- Employers not subject to COBRA that have 2-19 employees (in
place of COBRA), however, if the employer offers dental or vision
plans, the eligible individuals may elect to continue
those coverages.
Like COBRA, there are several notice requirements for Cal-COBRA. Unlike COBRA, Cal-COBRA applies to fully insured plans only, including PPOs and HMOs. Cal-COBRA includes government and church plans also.
