Texas State Continuation
In Texas, everything is big ... including the State Continuation Health Insurance
Law.
The law may be big however, it is complex with many players including: carriers,
employers, employees and dependents.
Texas State Continuation applies to fully insured medical plans offered by:
- Employers subject to federal COBRA that have 20 or more employees (post COBRA)
- Employers not subject to COBRA that have 2-19 employees (in place of COBRA)
Texas State Continuation is similar to COBRA in some ways, yet different in others.
Like COBRA, there are several notice requirements for Texas State Continuation.
Unlike COBRA, Texas State Continuation applies to fully insured medical plans only.
There is also no exception for government and church plans. They too, must comply.
Qualifying Events for COBRA also differ from those for Texas State Continuation
as do the requirements for elections and payments.
